Thai leasehold, explained

A plain guide to the ways a foreigner holds property in Thailand.

Foreign ownership in Thailand is more straightforward than its reputation suggests, provided the structure fits the asset.

Freehold and the foreign quota

A foreigner may own a condominium outright within a building’s 49% foreign quota — the cleanest form of title available.

Leasehold structures

Land and villas are typically held on a registered lease, often with renewal terms. The lease is registered against the title at the Land Office.

What we advise

We review the title, the quota position and the lease terms before any commitment, and bring in independent counsel where it matters.
